1. Agreement to Terms
These Terms and Conditions ("Terms") govern your use of the Monty's Lighting Co. website and any services requested through it. The website and the services offered through it are operated by Rocha Winnings LLC DBA Monty's Lighting Co. ("Company," "we," "us," or "our"). By accessing our website or submitting a service request, you agree to be bound by these Terms.
2. About Our Services
Rocha Winnings LLC DBA Monty's Lighting Co. provides holiday, permanent, landscape, and commercial lighting services throughout Richmond & Central Virginia, with commercial and multi-site projects available statewide. Services include:
- Holiday lighting design, installation, removal, and storage
- Permanent architectural LED lighting systems
- Landscape lighting — path, accent, and uplighting
- Commercial lighting for businesses, HOAs, and property managers
All services are performed by or under the supervision of licensed and insured professionals. We reserve the right to decline any project at our discretion.
3. SMS Messaging Terms
Our quote forms carry two separate SMS consent checkboxes. Checking a box is your express written consent to receive text messages from Rocha Winnings LLC DBA Monty's Lighting Co. in that category; leaving it unchecked means we will not send you that category of message. Checking one does not opt you into the other. The transactional box is required to submit a quote request, since text is how we respond to it; the marketing box is optional.
- Transactional messages — quote confirmations, appointment scheduling and reminders, crew arrival notices, project status updates, and follow-up communications.
- Marketing messages — seasonal booking reminders, special offers, and new service announcements.
Consent to receive marketing text messages is not a condition of purchasing any goods or services; that box is optional and your quote request is processed either way. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time. Reply HELP for help. We do not sell or share your phone number with third parties for their own marketing purposes. No mobile information is shared with third parties or affiliates for marketing or promotional purposes.

4. Estimates & Quotes
Submitting a quote request does not constitute a contract. A final price is not binding until it has been confirmed in writing following an in-person property assessment, accepted and signed by the customer, and accompanied by any deposit specified in the written proposal. Price ranges displayed on our website represent typical projects and do not guarantee final pricing.
5. Deposits & Payment
Deposit amount, payment schedule, and due dates are specified in your written proposal and are agreed to at signing. The remaining balance is due upon satisfactory completion of the work unless your proposal states otherwise. Overdue balances may be subject to late fees and collection proceedings.
6. Workmanship Warranty
Completed work is warranted against defects in workmanship for the period stated in your written proposal. Any such warranty covers labor and installation defects only — it does not cover material defects (covered by manufacturer warranties), damage from acts of nature, vandalism, normal wear and tear, or modifications made by others after completion. Warranty claims must be submitted in writing to info@montyslightingco.com within the warranty period.
7. Scheduling & Cancellations
Installation dates are scheduled once a proposal is signed. Cancellation notice requirements and any deposit forfeiture for late cancellation are set out in your written proposal. Holiday lighting work is seasonal and scheduled on a first-come basis; we cannot guarantee a specific install date for requests received late in the season.
8. Customer Responsibilities
- Provide accurate property and contact information
- Ensure clear access to the work area on the scheduled date
- Notify us of any underground utilities, buried lines, or known hazards
- Ensure adequate and safe electrical service is available at the property
- Obtain any required HOA or property-owner approvals prior to scheduling
9. Limitation of Liability
To the fullest extent permitted by law, Rocha Winnings LLC DBA Monty's Lighting Co.'s total liability for any claim shall not exceed the total amount paid by you for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
10. Carrier Liability Disclaimer
Mobile carriers (including but not limited to AT&T, Verizon, T-Mobile, and others) are not liable for delayed or undelivered SMS messages. Message delivery is subject to the terms and conditions of your mobile carrier. Rocha Winnings LLC DBA Monty's Lighting Co. is not responsible for any charges incurred by your mobile carrier related to SMS communications.
11. Age Restriction
You must be at least 18 years of age to submit a service request or consent to receive SMS communications from Rocha Winnings LLC DBA Monty's Lighting Co.. By submitting a form on our website, you confirm that you are 18 years of age or older. We do not knowingly collect personal information from or send SMS communications to individuals under the age of 18.
12. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia. Disputes shall be resolved by binding arbitration in Hanover County, VA, except that either party may seek injunctive relief in a court of competent jurisdiction.
13. Changes to These Terms
We reserve the right to update these Terms at any time. Continued use of our website after updates constitutes acceptance of the revised Terms.
